Do collection agencies report to the credit bureaus?

June 15, 2010 - 11:07 pm 1 Comment

I have a couple of credit card charge-offs on my credit report, but I have been paying on them through collection agencies. Do those ever show on your credit report?

If you pull your credit report from http://www.annualcreditreport.com you will probably find that these debts are already listed.

You will also find out that once you have paid them, they will continue to stay there as a negative item. Normally, once a debt is paid all the collection agency does is put "paid" on your history. But it will still reflect that it was in collections or had late payments.

If the reason you are paying these bills is to improve your credit, you need to contact the collector and have them agree IN WRITING to delete the entry once it has been paid off. Otherwise, you are just throwing away your money.

Can a scavenger bill collector report to the credit bureaus?

June 15, 2010 - 11:07 pm 4 Comments

I have a credit card debt that went into collections 7 years ago. It was a $500 credit card that reached $1600 after fees and interest. It has been turned over to a scavenger bill collector and they now want $2700. I am in TX and the SOL is 4 years. Can they still report this account on my credit report? I have not made contact with any one.

Yes, even scavenger or zombie bill collectors can report debts to the credit bureaus.

However, derogatory items age off your credit report 7-1/2 years after the date of first deficiency. Collection agencies cannot report the debt if it is beyond the reporting period. Should it show up on your credit report, dispute it as being beyond the reporting period.

Additionally, since you know the debt is beyond the SOL for your state, you can simply send the collection agency a certified, return receipt letter telling the to cease and desist all contact. They have to stop all contact. But will probably sell the debt to another zombie collector. You may have to send a letter to the next one.

Don’t waste your time talking to them on the phone.

Do the three credit reporting agencies use your wealth when they calculate your credit score?

June 15, 2010 - 11:06 pm 7 Comments

Consumer A has $5 dollars in the bank but manages to pay his bills on time. Consumer B has $5 million in the bank but is disorganized and pays some bills late. Who has the better credit score?

No they do not credit scores are based on the following factors only;

1. Payment history 35%
2. Time in bureau 15%
3. Types of credit 10%
4. New credit 10%
5. Debt to credit ratio 30%

The credit bureaus have no way of knowing how much money people make.

So consumer A would have the better socre.

Can the credit reporting agencies keep negative info on after 7 years?

June 15, 2010 - 11:06 pm 5 Comments

I have several items schedualed to come off in te next two months because of the seven year limit… Some people have told me that the collection agencies can just resubmit these debts as new and get them put back on, or get the date moved back… Is that true? What can I do about it?

No it’s not legal to re-age accounts, as a matter of fact it’s a violation of the F.C.R.A. and you can sue if this happens, it’s a $1,000.00 fine for each violation.

How would my landlord go about reporting my good credit to the credit reporting agencies?

June 15, 2010 - 11:06 pm 3 Comments

Trying to build credit and have lived in the same house for 3 years, always paid on time.

Landlords do not report rent payments as they are not debt. However, this can assist you in the future as you will have a good rental history. You can use it as a credit reference for future credit applications.

Good luck and keep paying on time as good things will happen!

How can I ask the credit reporting agencies to accept information on a deadbeat payer?

June 15, 2010 - 11:06 pm 4 Comments

A husband and wife team purchased a tractor truck from me and were making payments according to our agreement, which they signed. They are now not making payments and have decided to keep the truck.

I want to pressure them by placing the loss on their credit profiles. How do I do this??

file a lawsuit against them. Make sure that you have all your signed documents.

Will disputing items on credit report effect the date it is originally scheduled to be removed?

June 15, 2010 - 11:06 pm 1 Comment

I have a few items on my credit report that show "scheduled to continue on record until June 2009. If I dispute these items now could those accounts be extended and remain on credit report past date originally said?

No.

This is per the Fair Credit Reporting Act and nothing but nothing resets that time line.

by filing disputes on your credit report, how does it effect your credit score? or does it at all?

June 15, 2010 - 11:06 pm 1 Comment

First of all there is some really bad advice in some circles telling people to file blanket disputes against derogatory reporting on their credit report regardless of whether they are erroneous or not. The reason they say this is because they know that sometimes disputes carry over the 30 days required by law and through a loophole are automatically dismissed. HOWEVER in many legal circles this is considered credit fraud and I have a tendency to agree.

Now then having said that and assuming you really have errors in your reporting if those errors are removed it definitely helps increase your credit score. Below are some fantastic links about credit reporting and credit scores. Even though the page is partly about avoiding foreclosure the resources can also help you follow the law and exercise ethics when dealing with your own credit report.

AT ALL COSTS avoid scammers (crooks) who want to charge you hundreds of dollars and guarantee your credit score to increase by using a "legal" method of adding you to some other person’s credit as an "authorized user". It becomes a crime when you use your new credit rating based on that factor to obtain new credit. At that time it becomes credit fraud and conspiracy to commit credit fraud.
